1. About Pad

Pad is an online property marketplace that allows users to list, browse, and enquire about properties worldwide..

Pad is not a licensed real estate agent and does not act as an agent, broker, or representative for any party. Pad is a technology platform and advertising medium only and does not provide real estate, financial, or legal services of any kind.

All transactions and negotiations occur directly between buyers and sellers. Enquiries are made directly via the seller's personal email address — Pad does not provide an in-app messaging or chat service.

2. Eligibility

You must be at least 18 years of age to use Pad. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

If you are registering on behalf of a business, company, or real estate agency, you represent and warrant that you have the authority to bind that entity to these Terms, and references to "you" in these Terms include that entity.

3. Account Registration

To access Pad, you must create an account. All users are required to register before browsing or listing. You agree to:

• Provide accurate, current, and complete information during registration

• Keep your account credentials secure and confidential

• Notify us immediately of any unauthorised use of your account at sy.padapp@gmail.com

• Be responsible for all activity that occurs under your account

4. Listing Rules

When creating a listing on Pad, you agree to:

• Only list properties you own or have legal authority to list

• Provide accurate, truthful, and complete information about the property

• Not include misleading, deceptive, or fraudulent content

• Not list a property without the knowledge or consent of the owner

• Not misrepresent your identity or professional credentials

• Not list properties that are subject to legal disputes without disclosure

• Remove or update your listing promptly if circumstances change

Pad reserves the right to remove any listing at its sole discretion without notice.

Licensed Real Estate Agents

If you are a licensed real estate agent listing a property on behalf of a vendor, you additionally warrant that:

• You hold a current and valid real estate licence in the relevant jurisdiction

• Your listing complies with all applicable laws and regulations in that jurisdiction, including but not limited to jurisdiction-specific requirements such as the Statement of Information obligations under the Estate Agents Act 1980 (Vic) and equivalent obligations in other states, territories, and countries

• You will keep your licence current for the duration of any active listing and notify Pad immediately if your licence lapses or is suspended

• You will provide any legally required documents (such as a Statement of Information) as part of your listing where required by applicable law

For Victorian residential listings: the Statement of Information must be included with online advertising under Victorian law. It is the agent's responsibility to upload and maintain this document as part of their listing on Pad.

5. Fees and Payments

Pad offers the following listing plans:

Monthly Plan — $99/month

A recurring monthly subscription with a 7-day free trial. You will not be charged during the trial period. After the trial, your payment method will be charged $99/month. You may cancel at any time and your listing will remain active until the end of the current billing period.

Annual Plan — $450/year

A one-time annual payment giving you 12 months of listing visibility. At the end of the 12-month period, you will need to renew to keep your listing active.

Launch Offer — First 100 Listings Free

The first 100 listings on Pad are completely free using the promo code LAUNCHPAD at checkout on the annual plan. This offer is limited to one redemption per user and is subject to availability.

All payments are processed securely through Stripe. By making a payment, you agree to Stripe's Terms of Service available at stripe.com/legal. If payment fails or a subscription lapses, your listing will be automatically removed from the map until payment is resolved.

6. Refunds

Due to the nature of digital listing services, Pad does not offer refunds on completed payments except where required by applicable consumer law.

• Monthly Plan: You may cancel at any time. No refund will be issued for the current billing period. Your listing will remain active until the end of the paid period.

• Annual Plan: Annual payments are non-refundable except where required by law.

• Free Trial: If you cancel during the 7-day free trial period, you will not be charged.

7. No Real Estate Advice

Pad is a marketplace platform only. Nothing on Pad constitutes financial, legal, or real estate advice. You should seek independent professional advice before making any property-related decisions.

Pad does not verify the accuracy of any listing information and makes no representations or warranties regarding any property listed on the App.

8. Agent Compliance Responsibility

Where a licensed real estate agent uses Pad to list a property on behalf of a vendor, the agent is solely responsible for ensuring their use of the platform and all listing content complies with:

• The real estate licensing laws of the relevant jurisdiction

• All advertising and disclosure obligations applicable to the listing

• The professional conduct standards imposed by their licensing body

• Any obligations owed to their vendor client

Pad does not supervise, verify, or take responsibility for the conduct of agents using the platform. Any complaints regarding agent conduct should be directed to the relevant licensing authority (e.g. Consumer Affairs Victoria, NSW Fair Trading, or equivalent).

9. Prohibited Conduct

You must not use Pad to:

• Post false, misleading, or fraudulent listings

• List a property without the knowledge or consent of the owner

• Falsely claim to be a licensed real estate agent or misrepresent your credentials

• Harass, abuse, or harm other users

• Violate any applicable laws or regulations

• Attempt to gain unauthorised access to the App or its systems

• Use automated tools to scrape or extract data from the App

10. Intellectual Property

All content, trademarks, logos, and intellectual property on Pad (excluding user-submitted listings) are owned by or licensed to Pad. You may not reproduce, distribute, or use any Pad content without prior written permission.

By uploading listing content (including photos and descriptions), you grant Pad a non-exclusive, royalty-free licence to display that content on the platform for the duration of your listing.

11. Indemnity

You agree to indemnify, defend, and hold harmless Pad and its operators from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from:

• Your listing content

• Your breach of these Terms

• Your breach of any applicable law or regulation

• Any dispute between you and another user

12. Limitation of Liability

To the maximum extent permitted by applicable law, Pad and its operators are not liable for any direct, indirect, incidental, or consequential loss or damage arising from your use of the App, including but not limited to:

• Inaccurate or misleading listing information provided by users

• Any dealings or disputes between buyers and sellers

• Loss of data or interruption of service

Nothing in these Terms limits any rights you may have under applicable consumer protection laws that cannot be excluded by contract.

13. Privacy

Your use of Pad is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Pad, you consent to the collection and use of your information as described in the Privacy Policy.

14. Termination

Pad reserves the right to suspend or terminate your account at any time for breach of these Terms or for any other reason at its sole discretion. You may delete your account at any time by contacting us at sy.padapp@gmail.com.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via the App or by email. Your continued use of Pad after changes are posted constitutes your acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of Victoria, Australia. If you are accessing Pad from outside Australia, you are responsible for compliance with your local laws to the extent they apply. To the extent permitted by applicable law, any disputes arising from these Terms will be subject to the jurisdiction of the courts of Victoria, Australia.
